Terms and Conditions
Effective 23 September 2026
These terms cover buckupcoaching.com and the coaching I provide. I am John Buchan, operating as Buck Up Coaching, based in British Columbia, Canada. Throughout, “I” means me, and “you” means you. By booking a session or using this website, you agree to these terms.
They are written in plain language on purpose. Every word of them is binding. Clauses 11 and 12 limit what you can claim from me, so read those two carefully.
1. What you get
I provide one-to-one coaching sessions, delivered remotely by video call. Each session is thirty minutes long and is booked and paid for individually. There is no program, subscription or ongoing commitment. You book a session when you want one.
A session is a single conversation. Unless I agree otherwise in writing, it does not include messaging, check-ins or support between sessions.
2. What coaching is not
Coaching is a forward-looking process. We set goals, build habits, and I hold you accountable for what you said you would do.
It is not therapy, counselling, psychology, medical care, nutrition therapy, physiotherapy, or financial, investment or legal advice. Do not use it as a substitute for any of them.
I am not a doctor, psychologist, registered clinical counsellor, dietitian, physiotherapist, accountant, financial adviser or lawyer, and I do not claim to be. I will not diagnose or treat any physical or mental health condition, and I will not prescribe medication, supplements, diets or training that needs professional clearance.
If what you need falls outside coaching, I will tell you plainly and encourage you to get the right professional help. Decisions about your own health, money and affairs remain yours.
Never use messaging for an emergency. Call 911, or the Suicide Crisis Helpline at 988.
3. No guarantees
What you get out of coaching depends on your own effort, honesty and circumstances, most of which I do not control. I do not promise any particular result, in health, fitness, income, work, relationships, habits or wellbeing. Nothing on this website, in my marketing, or in any conversation with me is a guarantee. Anything I say about another client is an example, not a promise of what will happen for you.
4. Who I can work with
You must be at least eighteen and able to enter a binding contract. I may decline or cancel a booking, with a full refund, if I judge that coaching is not the right fit for you.
5. Fees and payment
- A session costs $50 CAD for thirty minutes, plus tax if it applies.
- You pay in full when you book, through my booking system. Payments are handled by Stripe, and I never see or store your full card details.
- This is not a subscription. Nothing renews, and your card is not charged again unless you book another session.
- I am not registered for GST at present. If registration becomes required, tax will be added to future bookings.
- I may change the price for future bookings at any time. A session you have already booked keeps the price you paid.
6. Booking
A session is confirmed once you have chosen a time and your payment has gone through. By booking a session, you confirm that you have read and agree to these terms.
7. Rescheduling, cancelling and refunds
- You can move or cancel a session with at least 24 hours' notice, using the link in your confirmation email. If you cancel in time, you can choose a full refund or a new time.
- If you cancel with less than 24 hours' notice, or do not attend, the session is used and not refunded.
- If you are more than 10 minutes late, I may treat the session as used. If we start late, the session still ends at the scheduled time.
- If I have to cancel, you choose a full refund or a new time.
- I may end a session early, without refund, if you are abusive or threatening.
- None of this affects any right you have under consumer protection law.
8. During a session
- Sessions take place by video call at the time booked.
- Please join from a quiet, private place with a working connection.
- If a technical problem on my side stops the session, I will offer you a new time or a full refund.
9. Confidentiality
I keep what you tell me private and will not pass it on without your consent, unless the law requires it, I need to tell my own advisers under the same duty of confidence, or I reasonably believe someone is at risk of serious harm.
I will not use your name, photo, words or results in any marketing without your written consent first. You can give it or refuse it freely, and withdraw it at any time for future use. Saying no makes no difference to your coaching.
One thing to be clear about: this is a promise in a contract, not legal privilege. Coaching does not carry the privilege that attaches to a doctor, a lawyer or a registered clinical counsellor.
10. What you agree to do
- Tell me the truth, and tell me promptly if something important changes;
- Show up to sessions on time;
- Take responsibility for your own decisions and actions, and for what follows from them;
- Get clearance from a doctor before starting or changing any exercise, diet, sleep or medication routine we discuss, and tell me about any condition that would make a change unsafe;
- Get proper professional advice before acting on anything we discuss about your health, your money or your legal position;
- Raise any concern about the coaching with me directly.
11. Your decisions, your risk
You agree that:
- Coaching is discussion, questions, encouragement and targets. Every decision about what to do, and every action you take, is yours alone and freely chosen;
- Acting on what we discuss, including any change to your exercise, diet, sleep, medication, work, money, living arrangements or relationships, carries real risk of physical, psychological and financial harm;
- You accept those risks in full. You have had the chance to get independent professional advice, and to say no to anything I suggest;
- You are not relying on anything I have said beyond what is written in these terms.
To the fullest extent the law allows, you release me from, and agree not to bring, any claim for loss, damage, injury, illness, cost or expense of any kind arising from your participation in coaching or from any decision or action you take, whether or not we discussed it first.
This does not cover loss caused by my own negligence, wilful misconduct or fraud, or any liability the law does not let me exclude.
12. Limits on my liability
To the fullest extent the law allows:
- I provide coaching as it is. I give no warranty or guarantee of any kind, stated or implied, including that it is fit for any particular purpose;
- I am not liable for indirect or knock-on loss, for lost profit, income, opportunity, savings, data, goodwill or reputation, or for physical injury, illness or psychological harm arising from action you choose to take;
- I am not liable when a third-party platform fails or is unavailable, including the video, scheduling, messaging, payment and hosting services;
- My total liability, on any basis, is limited to the fees you paid me for sessions in the three months before whatever gave rise to the claim;
- Any claim must be brought within one year of when you first knew about the circumstances behind it;
- Nothing here excludes liability the law does not let me exclude, including fraud, or death or personal injury caused by my negligence, and nothing here affects your rights under consumer protection law.
13. My materials
The plans, worksheets, frameworks, written material and website content I supply stay mine. You may use them for yourself. You may not copy, publish, share or sell them, or use them to coach anyone else.
14. Your personal information
I collect and use your personal information only to deliver and run the coaching and to talk to you about it. I handle it under British Columbia's Personal Information Protection Act. I do not sell it, and I share it only with the services I use to run the business, such as my payment processor, scheduling tool and email provider. I keep records for seven years after we finish, which is the period Canadian tax law requires, and then destroy them securely. You can ask to see or correct your information by emailing me.
15. Communication and this website
Coaching happens by video call and written message. No electronic communication is completely secure or completely reliable, so do not send me anything you would not risk being intercepted, and I am not responsible when a third-party platform fails.
This website is here for information. I try to keep it accurate, but I do not warrant that it is complete or current, and nothing on it forms part of any contract until confirmed in writing. I may change or remove any part of it at any time.
16. BC law and general
- Governing law. These terms are governed by the law of British Columbia and the federal law of Canada that applies here. If we disagree, we will first try to sort it out by talking directly. If that does not work, either of us can take it to the courts of British Columbia, or to the Civil Resolution Tribunal where the claim falls within its jurisdiction.
- Independent contractor. I work as an independent contractor. Nothing here makes either of us the other's employee, partner, agent or fiduciary.
- Changes to these terms. I may update them. A change never applies to a session you have already booked. The version that applies to you is the one published here on the date you booked.
- The whole agreement. These terms form the whole agreement between us and replace anything discussed beforehand.
- If part of it fails. If any part cannot be enforced, that part is removed and the rest still applies. Not enforcing something once does not waive it.
- Transfer. You cannot transfer your rights under these terms. Coaching is personal to you.
- Beyond our control. Neither of us is liable for a delay or failure caused by something outside our reasonable control.
- What survives. Clauses 3, 9, 11, 12, 13, 14 and the governing law provision above continue to apply after coaching ends.
